1. Who we are
Archipelago Games is the name Archipelago AI, LLC uses for its games (“we,” “us” and “our” below). We make Short Stack and WordGamr for Android phones and tablets, with iPhone and iPad versions coming soon. These Terms of Service apply to both games and to any updates to them.
By downloading or playing one of our games, you agree to these terms. If you don’t agree, please don’t play. Our Privacy Policy (https://arcg.co/privacy/) explains what information the games use. Google Play’s own terms also apply to anything you download or buy there.
The short version
- Play for fun on your own devices. Don’t cheat, hack, copy or resell our games.
- Coins and other in-game items have no cash value and work only in the game where you got them.
- Google Play handles every payment, subscription and refund.
- Your progress is saved only on your phone. If it’s deleted, we can’t bring it back.
- Nothing in these terms takes away rights you have under the consumer laws where you live.
2. Who can play
- WordGamr is made for a general audience. Short Stack is made for ages 13 and over.
- If you’re under 18, or not yet an adult where you live, you need a parent’s or guardian’s permission to play and to make purchases. Parents: Google Play lets you require approval for every purchase.
- Each game asks your age group before its first ad. If you say you’re under 13, ads are set up for children, and WordGamr doesn’t offer items with random contents, timed offers or limited-time Themes. Our Privacy Policy explains more.
3. Your license to play
Our games belong to us. We give you a personal, limited, non-exclusive, non-transferable license to install them on devices you own or control and to play them for your own entertainment. You may not:
- copy, sell, rent, share or redistribute a game, or offer a modified version of it;
- decompile, reverse engineer or modify a game, except where the law allows it;
- remove any copyright or other notices.
You’re welcome to share screenshots and videos of your play, including on channels that earn money, as long as you don’t suggest we sponsor or endorse you.
4. Your progress
There are no accounts. Each game saves your progress, settings, coins, tokens and items only on your phone, and we don’t keep a copy. If you uninstall a game, clear its data, use Account › Delete Account, or lose or replace your phone, what was saved there is gone and we can’t restore it. Android’s own backup may copy a game’s data to your Google account, depending on your phone’s settings, but we can’t promise it will.
Purchases that last, such as Lifetime and subscriptions, come back with Account › Restore Purchases on a phone signed in to the same Google account. Each game’s “Restore purchases” answer on our Support page lists what comes back. Coins, Chests and progress don’t move to a new phone.
5. Coins and in-game items
Our games have virtual items, such as coins, Revive Tokens, Hint Tokens, Power-ups, Chests, Styles, Themes and Music Tracks. Some you earn by playing and some you can buy. Either way, you get a license to use them in the game, not ownership of them. In-game items:
- have no real-world money value, and can’t be cashed out, sold, traded or given to anyone else;
- work only in the game where you got them;
- are gone once used: spent coins, used tokens and Power-ups, and opened Chests don’t come back.
Items with random contents: some items, such as Chests (and, in WordGamr, Rockets and Boost Boxes), have random contents. Before you buy one, the game shows the odds of getting each kind of reward.
Changes to items: we may change how items work, what they cost and what’s offered, and we may stop offering an item. Limited-time items and offers are available only for the time shown. We won’t take away a lasting item you paid for unless we stop offering the game, or the law, a platform rule or a security problem requires it.
6. Purchases and subscriptions
- Every purchase goes through Google Play, under its terms. We never see your card or bank details. Prices are shown before you buy and can vary by country.
- Subscriptions renew automatically at the price and for the period shown when you subscribe, until you cancel. Cancel anytime in Google Play at play.google.com/store/account/subscriptions. Uninstalling a game doesn’t cancel a subscription. After you cancel, it keeps working until the end of the period you’ve paid for.
- Lifetime, the Subscription and Ultra in each game remove the required ads between rounds or levels in that game. Ads you choose to watch for a reward are still offered.
- If you live in the European Economic Area or the United Kingdom, you normally have 14 days to cancel a purchase. Because in-game items are delivered as soon as you buy them, when you buy you ask us to deliver right away, and you agree that you lose that right once delivery starts. Your rights if something you bought is faulty or doesn’t work as described aren’t affected.
7. Refunds
Google Play handles refunds under its policies. Follow Google Play’s refund steps at https://support.google.com/googleplay/answer/2479637. If something you bought didn’t arrive or doesn’t work, contact us through our Support page with your player code and your Google Play order number, and we’ll help. If a purchase is refunded or reversed, what it unlocked may be removed.
8. Ads
Our games are free to play and show ads through Google AdMob. Ads come from other companies. We don’t make them or endorse what they offer, and we set limits on the kinds of ads that appear. When you choose to watch an ad for a reward, the reward is given after the ad finishes. If an ad doesn’t load or you close it early, there’s no reward. Our Privacy Policy explains how ads use your data and how to change your choices.
9. Play fair
Please don’t:
- cheat, or use bots, scripts, hacks, modified versions of a game, or changes to your phone’s date or time to get coins, rewards or items you didn’t earn;
- exploit bugs (if you find one, please tell us);
- interfere with ads, purchases or rewards, or make purchases you plan to reverse;
- use our games for anything illegal or harmful.
If you break these rules, we may remove items you got that way and stop offering you the game.
10. Photos you choose
If you set one of your own photos as a Background, it stays on your phone and we never receive it. Only use photos you have the right to use.
11. Our content
Our games, including their names, logos, art, music, sounds, word lists, levels and code, belong to Archipelago AI, LLC or the people who license them to us, and they’re protected by law. These terms don’t give you any rights to them beyond playing. If you send us ideas or feedback, we may use them without owing you anything.
12. Changes to our games
We update our games to add features, fix problems and keep them balanced. Some updates may be needed to keep playing. We may change or remove features, and we may stop offering a game. If we stop offering a game, we’ll try to tell you in the game or on arcg.co first.
13. Ending these terms
You can stop at any time by uninstalling the game. Cancel any subscription in Google Play first. These terms end for you if you break them. The sections on in-game items, our content, disclaimers, limits on liability and governing law still apply after that.
14. Disclaimers
We work hard on our games, but they’re provided “as is” and “as available.” To the extent the law allows, we don’t promise that they’ll always be available, work without errors or keep your saved progress, and we disclaim implied warranties, such as merchantability, fitness for a particular purpose and non-infringement. Some places don’t allow these disclaimers, so they may not all apply to you.
15. Limits on our liability
To the extent the law allows, we aren’t liable for indirect, incidental, special or consequential losses, or for lost progress, data or in-game items. Our total liability for any claim about our games is limited to the greater of what you paid us for that game in the 12 months before the claim, or US $50. Nothing in these terms limits liability that the law doesn’t allow us to limit, such as for fraud, or for death or personal injury caused by our negligence.
16. Governing law and disputes
These terms are governed by the laws of the State of Michigan, USA, not including its conflict-of-law rules. If you have a problem, please contact us first so we can try to fix it. If we can’t, disputes go to the state or federal courts in Michigan, unless the law where you live lets you bring a claim in your local courts. If you live in the European Economic Area or the United Kingdom, you also keep the protection of the consumer laws where you live.
17. Other terms
If part of these terms can’t be enforced, the rest still applies. If we don’t enforce a term right away, we can still enforce it later. These terms and our Privacy Policy are the whole agreement between you and us about our games. We may transfer these terms as part of a sale or reorganization of our business.
18. Changes to these terms
We may change these terms from time to time. The date at the top shows when they were last updated. If a change is significant, we’ll also tell you in the game. If you keep playing after a change, the new terms apply. If you don’t agree, please stop playing. When our games come to iPhone and iPad, we’ll update these terms first.
